Terms governing site, services, and consulting use

These Terms of Service ('Terms') govern the legal relationship between all natural and legal persons ('User') who use the sukruyusufkaya.com website, the content, training, consulting, and software services offered on the website ('Services'), and Şükrü Yusuf KAYA ('Service Provider'). By using the Services, you confirm that you have read, understood, and accepted these Terms.

1. Definitions

Service Provider: Şükrü Yusuf KAYA, a natural person resident in Türkiye; authorized operator of the sukruyusufkaya.com domain and all services offered. User: Any person who visits the website, views content, or purchases services. Services: Enterprise artificial intelligence consulting, online and in-person training programs, RAG/LLM solution architecture, articles, glossary, roadmaps, blog, and interactive learning platform — all site content. Content: Text, video, audio, code samples, images, certificates, quizzes, and data.

2. Scope of Services

Sukruyusufkaya.com offers the following service categories: (a) Freely accessible information content (blog, glossary, articles, roadmaps, RSS). (b) Membership-based learning platform (Free / Pro / Premium tiers, drip cohort, certificate exams). (c) Corporate AI training programs (on-site, hybrid, remote delivery). (d) One-on-one or corporate consulting (discovery, strategy, architecture, implementation roadmap). Service details, pricing, and delivery conditions are explained on relevant pages and formalized via contract.

3. User Obligations

When using the Services, the User: (a) Is obligated to comply with applicable Republic of Türkiye laws, international regulations, and these Terms. (b) Is obligated to provide accurate, current, and complete information when creating an account. (c) Is responsible for the confidentiality of account information and all activities performed through their account. (d) Cannot use the Services in any unlawful, harmful, harassing, obscene, discriminatory manner or in a way that violates another person's rights. (e) Cannot interfere with system security, rate-limiting mechanisms, or bot protection measures; cannot perform reverse engineering; cannot use scraping or automated data extraction tools.

4. Intellectual Property Rights

All text, images, video, code samples, training materials, slides, certificate designs, trademark, logo, domain name, and database structure on the website are protected under Law No. 5846 on Intellectual and Artistic Works and belong to the Service Provider. The User may view content for personal/educational purposes only; does not have the authority to commercially copy, reproduce, distribute, sell, or create derivative works without explicit written permission. Open-source code samples on the site are subject to the respective source license (default: MIT, unless otherwise stated). Third-party trademark names (OpenAI, Anthropic, Google, Microsoft, etc.) are used solely for identification purposes.

5. Fees and Payment

Prices for paid Services are clearly stated on the relevant page in Turkish Lira (TRY) or US Dollar (USD), VAT inclusive or exclusive. Payments are processed via PCI-DSS certified third-party payment providers (Stripe, iyzico, PayTR, etc.); the Service Provider does not store card information. Pricing for corporate consulting and custom training services is quote-based and takes effect with a mutually signed contract. Membership subscriptions renew automatically; unless canceled, you will be automatically charged at the end of each period.

6. Cancellation, Withdrawal, and Refund Policy

Online digital services: Under Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, if the digital content has been delivered after purchase (access has been opened), the right of withdrawal cannot be exercised. However, if there has been no interaction with the content, a full refund may be requested within 14 days. Membership subscriptions: You can cancel at any time; access continues until the end of the current period, the next period will not be charged. No pro-rata refund. Live training: Cancellations at least 14 days before the event date receive a 100% refund; 50% refund between 7-14 days; cancellations less than 7 days are non-refundable but may be transferred as credit to another program. Corporate consulting: Subject to the cancellation and termination provisions of the respective contract.

7. Limitation of Liability

Services are provided 'as is'. The Service Provider does not guarantee the accuracy, completeness, timeliness, or fitness for a particular purpose of the content. AI is a rapidly changing field; ensuring that published guides, code samples, and recommendations comply with the most current technology/regulations in effect at the time of implementation is the User's responsibility. The Service Provider cannot be held liable for direct, indirect, incidental, special, or punitive damages (including profit loss, data loss, business interruption). Total liability under all circumstances is limited to the total fees paid by the User in the last 12 months.

8. Disclaimer of Warranties

The website is not guaranteed to operate uninterrupted, error-free, or virus-free. Service interruptions due to dependencies on third-party services (Vercel, MongoDB Atlas, Stripe, Google Analytics, etc.) are not under the direct control of the Service Provider. External links in site content (LinkedIn, GitHub, academic resources, vendor documentation) are provided only for convenience; the content or availability of these sites is not guaranteed.

9. Third-Party Content and Services

The website may use embedded video (YouTube, Vimeo), code boxes (CodeSandbox, Stackblitz), embedded diagrams (Mermaid), and other third-party services. The privacy policies and terms of use of these services apply separately. Use of third-party services means you accept the terms of the respective provider.

10. Governing Law and Jurisdiction

These Terms are interpreted and applied under the laws of the Republic of Türkiye. Istanbul (Çağlayan) Courts and Enforcement Offices have exclusive jurisdiction in disputes arising from these Terms or the use of Services. Law No. 6502 on Consumer Protection is reserved for Users applying as consumers; the right to apply to Consumer Arbitration Committees and Consumer Courts may be exercised.

11. Changes to Terms

The Service Provider reserves the right to update these Terms at any time. Significant changes are communicated to active Users via email and the 'Last updated' date at the bottom of the page is refreshed. Continuing to use the Services after the changes means you accept the new Terms.

12. Force Majeure

The Service Provider cannot be held liable for delays or interruption of Services due to natural disasters, war, pandemic, cyber attack, internet infrastructure outage, government regulation, or other extraordinary circumstances beyond reasonable control (force majeure).

13. Severability

If any provision of these Terms is found invalid or unenforceable, the other provisions remain in full force and effect; the invalid provision is deemed replaced with the closest valid provision serving its purpose.
